The most suitable form depends on the type of innovation, the countries in which protection is required, and the commercial objectives of the breeder.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">Plant Breeders' Rights<\/h1>\n\n\n\n<h2 class=\"wp-block-heading\">The most commonly used protection for new plant varieties<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Plant Breeders' Rights protect new plant varieties that meet specific legal requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To qualify for protection, a variety must be:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>New<\/li>\n\n\n\n<li>Distinct from existing varieties<\/li>\n\n\n\n<li>Uniform<\/li>\n\n\n\n<li>Stable<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These requirements are commonly referred to as the DUS criteria (Distinctness, Uniformity and Stability).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once Plant Breeders' Rights are granted, the holder obtains exclusive rights relating to, among other things, the production, propagation, and commercial exploitation of the variety. Third parties may not propagate or commercialise the variety without permission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the jurisdiction, the protection period can extend to 25 or even 30 years.<\/p>\n\n\n\n<h1 class=\"wp-block-heading\">Plant Patents in the United States<\/h1>\n\n\n\n<h2 class=\"wp-block-heading\">An alternative protection system<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In addition to Plant Breeders' Rights, the United States has a system known as Plant Patents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A Plant Patent is exclusively available for asexually propagated plants and is subject to different requirements than European Plant Breeders' Rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For companies active in the U.S. market, a Plant Patent can form an important part of their protection strategy.
